Privacy Policy for JDE Construction & Facility Solutions (JDE CFS)

Introduction

JDE Construction & Facility Solutions (referred to in this policy as “JDE CFS,” “we,” “our” or “us”) owns and operates the website www.jdecfs.com.  We are committed to protecting the privacy of anyone who visits our website, submits information through our contact forms or applies to work with us.  This Privacy Policy describes what personal information we collect, how we use it and the choices you have regarding our use of your data.  By visiting our site or submitting information to us, you agree to the terms of this policy.

This policy applies to information collected through the website and any related online services or communications.  It does not apply to information collected offline or through employment-related activities.

Information We Collect

Information you provide voluntarily

When you fill out a contact form, request a quote, apply to become a vendor partner, subscribe to our newsletter, opt in to receive SMS text messages, apply for employment, or otherwise communicate with us, we collect the information you choose to provide.  Depending on the interaction, this may include your name, email address, phone number (if you elect to receive text messages), company or organization, job title, location, services of interest and any other details you share in the message.  Our policy emphasizes that we only collect the specific categories of data needed for the services we offer rather than listing every imaginable data type .  We do not ask for or knowingly collect sensitive information such as biometric identifiers, credit card numbers, medical information or communication logs .

Information collected automatically

Like many websites, we use cookies, pixels, log files and similar technologies to collect certain information automatically when you visit our site.  This may include your Internet Protocol (IP) address, device identifier, browser type and version, pages you view, time spent on pages, referring website, general geolocation (e.g., city/state) and the date/time of your visit.  We use this information to understand how visitors use our site, diagnose technical issues, maintain security and improve our services.  Our website may incorporate analytics tools (such as Google Analytics) and may embed social‑media plugins that can set their own cookies.  You can control cookies and similar technologies through your browser settings or our cookie banner.

Information from third‑party sources

We may receive information about you from other sources, such as social‑media platforms, marketing partners and data brokers, when you interact with our content on those platforms or where they are permitted to share the information with us.  For example, if you apply to become a vendor partner through a third‑party platform, that platform may send us your contact details.  We combine this information with information you provide to better understand your needs and improve our services.

How We Use Your Information

We use personal information for the following purposes.  We strive to be transparent about why each data point is needed because vague statements like “service improvement” do not sufficiently inform users .

  • Provide and maintain our services.  We use your information to respond to inquiries, provide facility solutions, coordinate vendor partnerships, schedule repairs or projects, and communicate with you about your requests.

  • Customer and vendor relationship management.  We maintain records of our communications and transactions with you to deliver consistent service, track project progress and administer vendor partnerships.

  • Website analytics and improvement.  We analyse usage data to understand traffic patterns, diagnose technical issues and make our website easier to use.  When analytics or cookies are used, we describe what data is collected and for what purpose rather than using generic phrases .

  • Marketing and communications.  With your consent where required, we may send you promotional messages about our services, events or job opportunities.  You can opt out of marketing communications at any time.

  • Recruitment and hiring.  If you apply for a job, we use your information to evaluate your application, communicate with you about the process and, if hired, administer your employment.

  • Legal and security.  We may use information to protect the safety and integrity of our website, detect fraud or illegal activities and comply with our legal obligations.

We do not use personal information to train third‑party AI models or automated decision‑making systems.  If our practices change, we will update this policy and provide clear disclosure as recommended .

Legal Basis for Processing (GDPR)

If you are located in the European Economic Area (EEA), the United Kingdom or Switzerland, we only process your personal information when we have a lawful basis under the General Data Protection Regulation (GDPR) or equivalent laws.  These bases include:

  • Contractual necessity: we process your information to fulfil a contract with you or take steps at your request before entering into a contract—for example, when responding to an inquiry about our services or processing a vendor application.

  • Legitimate interests: we process data for our legitimate business interests, such as improving our services, securing our website, preventing fraud and communicating with clients.  We balance these interests against your rights and expectations.

  • Consent: where we rely on consent, such as for marketing emails or certain cookie categories, you may withdraw it at any time.

  • Legal obligations: we process information to comply with laws, including tax, labour and construction licensing requirements.

Cookies and Similar Technologies

Cookies are small text files placed on your device when you visit a website.  We use them to remember your preferences, keep you signed in (if applicable), analyse website traffic and provide targeted marketing.  You can manage cookie preferences through the settings on your browser or via our cookie banner, including choosing whether to allow analytics, marketing or personalization cookies .  Rejecting or disabling cookies may affect certain features.

SMS Messaging & 10DLC Compliance

We use SMS text messaging via 10‑digit long code (10DLC) phone numbers to communicate with customers, vendors and applicants in the United States.  These messages may include service updates, appointment reminders, vendor outreach, customer support and occasional marketing promotions.  To comply with the carrier requirements for 10DLC campaigns, we adhere to the following practices:

  • Opt‑in consent: We will only send text messages if you have provided your phone number and affirmatively consented to receive SMS communications.  Consent may be obtained when you submit a form on our website that clearly discloses our intent to send text messages, or through a written or electronic agreement.  Providing a phone number without consent does not result in enrollment in SMS messaging.

  • Message frequency and content: Message frequency varies based on the nature of your relationship with us (for example, service updates during an active project).  We align our text messages with the use case under which we registered our 10DLC campaign (primarily customer care and occasional marketing) and do not send high‑risk or prohibited content, such as payday loans, get‑rich‑quick schemes, controlled substances, pornography, hate speech, phishing, fraud or deceptive marketing.  We monitor our messaging for compliance and will flag and remove any content that carriers could reject.

  • Sample messages: To illustrate how we communicate via SMS, here are examples of the types of messages you might receive:

    • Service update: “JDE CFS: Your maintenance appointment is scheduled for 2/15 at 10 AM. Reply CONFIRM to confirm or STOP to cancel.”

    • Vendor communication: “JDE CFS: Thank you for applying to be a vendor partner. Please submit your licensing documents by 3/1. Reply HELP for assistance or STOP to opt out.”

    • Promotional/marketing message: “JDE CFS: Discover our new EcoGrip flooring solutions! Save 10 % this month. Reply STOP to stop or HELP for help.”

  • Opt‑out instructions: You may opt out of SMS messaging at any time.  Reply STOP, UNSUBSCRIBE or CANCEL to any text message you receive from us, and we will promptly remove your phone number from our messaging list .  Reply HELP for help.  After you opt out, you will receive one final message confirming that you have been unsubscribed.

  • Data collection and retention: When you opt in to receive SMS messages, we record your phone number, the date and time of your opt‑in and the content of messages sent and received.  We retain these logs only as long as necessary to manage our SMS program and comply with legal or carrier audit requirements.  These records help us demonstrate that consent was obtained and document any opt‑out requests.

  • Explicit non‑sharing of SMS data: We do not sell, rent or share your phone number or SMS opt‑in data with third parties for marketing purposes.  This information is used solely to deliver text messages you have requested and to fulfil our obligations to you.  We may share your phone number only with trusted service providers that assist us in delivering our messages (such as our messaging platform), and we require them to keep this information confidential and use it exclusively for message delivery .  All categories of personal data described in this policy exclude text messaging originator opt‑in data and consent; this information will not be shared with any third parties.

  • Message and data rates: Standard message and data rates from your mobile carrier may apply.  Charges depend on your cellular plan and are not imposed by JDE CFS.

By enrolling in our SMS messaging program, you understand and agree to the above terms.  If you have any questions about our text messaging practices, please contact us using the information in the Contact Us section.

Sharing of Information and Third‑Party Processors

We sometimes share information with third parties to help us operate our business and provide our services.  This includes:

  • Service providers: companies that host our website, provide analytics services, send emails, process job applications, support marketing campaigns or provide customer relationship management software.  We contractually require these providers to handle your data confidentially and use it only for the agreed‑upon purpose.

  • Business partners and vendors: we may share contact details with trusted partners (e.g., subcontractors, trade professionals) when needed to carry out a project or facilitate a vendor partnership.

  • Legal or regulatory authorities: we may disclose information if required by law, court order or government request, or if necessary to protect our rights or the rights of others.

We do not sell personal information for monetary value.  When using third‑party processors or cross‑border services, we disclose the nature of those relationships, how much access they have and any safeguards in place, as recommended by best‑practice guidance .

Note on SMS opt‑in data: Phone numbers and text messaging opt‑in consent are treated as sensitive.  We do not share or disclose this information with any third parties (other than our messaging service provider) and we do not sell or rent SMS opt‑in data for marketing purposes .  Our messaging provider is contractually obligated to use phone numbers only to deliver our SMS messages and not for any other purpose.

International Data Transfers

If you access our site from outside the United States or provide information while located abroad, your information may be transferred to, and processed in, the United States or other countries where our service providers operate.  These countries may have data‑protection laws that differ from your jurisdiction.  We implement appropriate safeguards, such as standard contractual clauses, to protect your data when it is transferred internationally.

Data Retention

We retain personal information only as long as necessary to fulfil the purposes described in this policy, including any legal, accounting or reporting requirements.  Our retention practices reflect the principle that personal data should be deleted or anonymized once it has served its purpose .  For example, we may keep contact information while you are an active client or vendor partner and for a reasonable period afterwards in case of legal claims.  Where we are required by law to keep certain information (e.g., tax records or licensing documentation), we will retain it for the required period.

Security Practices

We employ administrative, technical and physical measures to safeguard personal information against unauthorized access, alteration, disclosure or destruction.  These measures include encryption in transit, secure servers, access‑control policies and periodic reviews of our security protocols.  Because technical details can be confusing, we explain our security practices in simple terms and emphasize that we continuously assess and update them .  However, no method of transmission over the Internet or method of electronic storage is completely secure.  We cannot guarantee absolute security but strive to protect your information.
